| Charls Sobhraj to remain in judicial custody till case concludes |

KATHMANDU, Oct 20 - The District Court ordered today that Charles Sobhraj Gurumukh be kept in him. Sobhraj was taken in remand for the murder case after he was released on ordinary date with regard to the immigration offence case filed by the Department of Immigration.
Sobhraj is accused of having murdered foreign nationals Laurent Armand Carriere and Connie Jo Bronizch in Kathmandu in 1975 after allegedly arriving in Nepal with a fake passport. Sobhraj had denied all the charges.
Advocate Sanjeev Ghimire who is pleading on behalf of Sobhraj told The Kathmandu Post that he would appeal to the appellate court tomorrow. "It is illegal to keep him in judicial custody when there is no evidence to back his arrival in Nepal in 1975," said Ghimire. The judicial provision number 17 of the Muluki Ain allows defendants to appeal to the appellate court demanding de-validation of District Court orders.
The murder case that was revived last week was filed after the arrest of Sobhraj in India. Till his arrest and admission in Indian High Court that he had committed murders in Kathmandu, police had no clue as to who the murderer could be. "After his admission, the police filed the case. His admission at the Indian High Court does not work as evidence for proving him guilty in Nepal’s Court," he argued.
If the District Court’s order is not de-validated, Sobhraj could be kept in judicial custody till the case concludes. |
